After winning the war for independence from Great Britain, the 13 adopted the Articles of Confederation as their system of government. However, the Articles proved to be ineffective, and only a few short years after gaining its independence, the young country was headed for fracture and failure. In the summer of 1787, 12 of the states (Rhode Island excepted) sent delegates to Philadelphia in a last-ditch effort to fix the Articles. But it soon became clear that the problems facing the young country were too great for the Articles of Confederation to address, even in an amended form. Thus, the delegates created a new Constitution.

Born in 1736, Patrick Henry was an attorney and a planter and an outstanding orator in the movement for independence. A contemporary of Washington, Henry stood with John and Samuel Adams among the leaders of the colonial resistance to Great Britain that ultimately created the United States. The first governor of Virginia after independence, he was reelected several times. After declining to attend the Constitutional Convention of 1787, Henry opposed the Constitution, arguing that it granted too much power to the central government.

When Clarence Thomas joined the Supreme Court in 1991, he found with dismay that it was interpreting a very different Constitution from the one the framers had written - the one that had established a federal government manned by the people's own elected representatives, charged with protecting citizens' inborn rights while leaving them free to work out their individual happiness themselves, in their families, communities, and states.
